Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and John Krueger (“Hearth,” “we,” “our,” or “us”) governing your use of the Hearth app and related services (the “Service”).

Please read these Terms carefully. They include an important Medical Disclaimer (Section 3), a limitation of our liability (Section 12), and an agreement to resolve disputes by individual arbitration and to waive class actions (Section 14). By creating an account or using Hearth, you agree to these Terms.

1. Who May Use Hearth

You must be at least 18 years old and able to form a binding contract to create an account, start a family circle, or accept these Terms. Younger family members (such as grandchildren) may participate in a circle when invited by an adult member, who confirms they are the child’s parent or guardian or have the parent’s permission and who is responsible for the child’s use of Hearth.

If you enter information about another person (such as an aging parent), you confirm that you have that person’s permission, or the legal authority, to do so and to share it within your family circle.

2. What Hearth Is — and Is Not

Hearth is a consumer wellness and family-connection app. It helps families share check-ins, reminders, photos, voice messages, a calendar, and plain-language wellbeing summaries.

Hearth is NOT a medical device, medical service, health-care provider, monitoring service, or emergency-response service. It does not diagnose, treat, or monitor any condition, and it does not provide medical, nursing, or pharmacist services or advice.

3. Medical Disclaimer

HEARTH IS FOR GENERAL WELLNESS AND INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Always seek the advice of a physician, pharmacist, or other qualified health professional with any questions about a medical condition or medication. Never disregard or delay seeking professional advice because of something you read or saw in Hearth.

Information and AI-generated summaries in Hearth — including medication information and wellbeing summaries — are general, may be inaccurate or incomplete, and must not be used to make medical decisions. Using Hearth does not create a doctor-patient or other professional relationship.

4. Not for Emergencies

Hearth is not monitored in real time and must not be relied on for urgent or emergency needs. If you or your loved one is experiencing a medical emergency, call 911 or your local emergency number immediately.

Reminders, alerts, and notifications depend on devices, networks, and third-party services we do not control, and may be delayed, missed, or not delivered. Do not rely on Hearth as the only way to ensure a medication is taken or that someone is safe.

5. AI Features

Some features use artificial intelligence to generate summaries and answer general questions. AI output is produced automatically, can be wrong or misleading, and is provided for general information only. You are responsible for evaluating it and should verify anything important with a qualified professional.

6. Your Account

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for activity under your account. Notify us promptly of any unauthorized use.

7. Your Content

You retain ownership of the photos, recordings, journals, notes, and other content you submit (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you and your family circle.

You are responsible for Your Content and confirm you have the rights and any necessary consents to share it — including the consent of anyone depicted or recorded. Recording laws vary by state; only record voice or video where you are permitted to do so.

8. Acceptable Use

You agree not to use Hearth to break the law, infringe others’ rights, upload harmful or unlawful content, attempt to access accounts or data that are not yours, disrupt or probe the Service, or reverse engineer, scrape, or resell it.

9. Third-Party Services

Hearth relies on third-party services such as Apple, your device platform, our cloud provider, and our AI provider. Your use of those services may be subject to their own terms, and we are not responsible for them.

10. Subscriptions and Payments

Hearth may offer paid plans. If you purchase a subscription, the price, billing period, and renewal terms will be disclosed at purchase. Subscriptions purchased through an app store are billed and managed by that store under its terms, and you can manage or cancel them in your app-store account. Except where required by law or store policy, payments are non-refundable.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that reminders or alerts will be delivered. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTH AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON THE SERVICE, INCLUDING ANY MISSED, DELAYED, OR UNDELIVERED REMINDER OR ALERT, OR ANY HEALTH OUTCOME.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless Hearth from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or Your Content.

14. Dispute Resolution; Arbitration; Class-Action Waiver

Informal first: before filing anything, you agree to contact us at support@lightyourhearth.com and try in good faith to resolve the dispute for at least 30 days.

Binding arbitration: if we cannot resolve it, you and we agree to resolve any dispute by final and binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court.

Class-action waiver: disputes will be handled individually. You and we waive any right to participate in a class, collective, or representative action.

Opt-out: you may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@lightyourhearth.com with your name and a statement that you opt out.

Governing law: these Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules.

15. Termination

You may stop using Hearth and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive (including Sections 3, 7, 11–14) survive termination.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you in the app or by email and update the “Last updated” date. Your continued use after an update means you accept the revised Terms.
